The Michigan Vehicle Code (Act 300 of 1949) and Michigan Public Act 33 of 2024 dictates the procedure for designating a posted speed limit on a road in Michigan. The procedure requires that an engineering and traffic investigation be conducted taking into consideration prevailing vehicle speeds, crash history, traffic volumes, and road conditions. The decision to post a speed limit must be unanimous between the road commission, the township board, and the department of state police with the final traffic control order provided by the department of state police. The speed samples we took on Martz Road between Whittaker Road and Rawsonville Road resulted in an 85th percentile speed ranging from 52 MPH to 55 MPH. Studies have shown that setting the speed limit at the 85th percentile speed results in more uniform traffic flow and fewer collisions. Public Act 33 of 2024 allows a speed limit to be set lower than the 85th percentile if a hazardous situation can be demonstrated. We have added this to the list for the Michigan State Police to review and perform their own study to determine if a lower speed limit is warranted.
